Al, this got me really fired up so I’m now searching for the solution. Upwork is registered in the United States, right? So, please reach out to the Office of the Ombudsman in the state where Robin is in and the bank is in. I’d suggest writing to Upwork again and asking: 1) to escalate this matter to Upwork’s internal Ombudsman; 2) provide the complaint process steps for escalating this matter outside of Upwork, such as the Ombudsman’s office in the state the company is registered in; 3) provide the proof from the bank stating Robin defrauded someone and the proof of charges being laid against him.
Most likely, no one pressed charges against Robin, but the bank doesn’t want to report a loss, and Upwork is shifting the blame onto you while you’re not responsible.
